The rules behind the numbers
Under Article 24 of the Labor Standards Act, overtime on a normal working day is paid at 1⅓ times the regular hourly wage for the first two hours and 1⅔ times for hours three and four; a working day may not exceed 12 hours. Work on a rest day (the flexible day off each week) is paid on top of the monthly salary at 1⅓ for the first two hours, 1⅔ from the third to the eighth hour and 2⅔ for hours nine to twelve. On a national holiday Article 39 requires wages to be doubled: any work up to eight hours earns one extra day's pay (8 × hourly), while hours nine and ten, and eleven and twelve, follow the weekday multipliers. The regular hourly wage of a monthly-paid worker is the monthly salary ÷ 30 days ÷ 8 hours, i.e. ÷ 240. This calculator uses the Ministry of Labor's conventional rounded multipliers 1.34, 1.67 and 2.67.
Things to keep in mind
- Article 32 caps overtime at 46 hours a month — rest-day hours count, holiday hours within 8 do not — or 54 hours a month and 138 in three months with union or labor-management consent.
- A regular day off (例假) may only be worked in an emergency; pay is doubled and a compensatory day off must be given. It is not a separate input here.
- Monthly salary means the agreed wage for regular hours. Allowances that are wages count; pure expense reimbursements do not.
- This is an estimate. Company rules and collective agreements can only be more generous than the Act, never less.
